Allotments
When determining the surplus amount, FAMIS will determine an allotment for the participant’s spouse and dependents. An allotment is intended to help the participant’s spouse and dependents meet their normal living expenses.
FAMIS allows as a deduction allotment made available to:
- Community spouse
- Minor children of either spouse
- Adult dependent children of either spouse
- Dependent parents of either spouse
- Dependent siblings of either spouse
Community Spouse Allotments:
When the Assistance Group includes a community spouse and an institutionalized spouse, the Community Spouse Allotment Information screen appears in the controlled flow. FAMIS determines the allotment amount for the community spouse by taking the following steps:
- Considers the community spouse’s shelter costs
- Deducts the shelter standard from actual shelter costs to determine the excess shelter costs
- Adds excess shelter costs, if any, to the minimum maintenance standard to arrive at a total maintenance standard
- Determines if the total maintenance standard exceeds the maximum maintenance standard
- Considers the community spouse’s income
- Deducts the community spouse’s income from the total maintenance standard or the maximum maintenance standard, whichever is lower
- Allows the remainder as a deduction, if the institutionalized spouse opts to make this income available to community spouse
If the institutionalized spouse wishes to make the maximum allotment available, enter ‘Y’ in the ‘Max Allot’ field.
If the institutionalized spouse chooses to make a lower amount available, enter ‘N’ in the ‘Max Allot’ field and the amount to be made available in the ‘Client Allot’ field.
If a hearing decision or court sets a higher allotment, enter the amount in the ‘Hearing Allot’ field.
Minor/Dependent in the Home Allotments:
When the Assistance Group includes a minor dependent and an institutionalized spouse, the Minor/Dependent Allotment Information screen occurs in the controlled flow. FAMIS determines the allotment for minors or dependents living with the community spouse by taking these steps:
- Considers the minor or dependent’s income
- Deducts the minor or dependent’s income from minimum maintenance standard
- Divides the remainder by three
- Allows the results as allotment
If a hearing decision or court sets a higher allotment, enter the amount in the ‘Hearing Allot’ field.
Minor/Dependent Living Outside the Home Allotments:
For any application including an institutionalized person, the Minor Living Outside Allotment Information screen occurs during the controlled flow. FAMIS determines the allotment for minors or dependents living outside the home by taking these steps:
- First allows allotments to the community spouse and dependents who live with the community spouse.
- Using MAF assistance group rules, determines the budget group for the minor child(ren).
- Using MAF income rules, determines the gross income of the minor child.
- Determines the adjusted gross income by subtracting any deductions allowable by MAF rules from the gross income.
- Determine the deficit by subtracting the adjusted gross income of the minor child from the July 1996 AFDC percentage of need standard determined by the budget group. (See Appendix D).
- The amount of the allotment may be up to but not exceed the amount of the deficit.
If the institutionalized spouse has a dependent living outside the home, enter the ‘Size of HH’ and ‘Dependent Earned Inc’ to allow FAMIS to calculate the allotment. If a hearing decision or court sets a higher allotment, enter the amount in the ‘Hearing Allot’ field.
Verification
HC – verification of shelter expenses is required for the purposes of determining an allotment.
