Month of Assessment-Does Division of Assets Apply?

STEP 1:

Did the person’s institutionalization or receipt of HCB waiver services begin prior to September 30, 1989?

• • If YES, go to Step 2.
  • If NO, go to Step 3.

STEP 2:

Has the person left a licensed Supplemental Nursing Facility or Intermediate Care Facility bed for at least 30 days and reentered a licensed Supplemental Nursing Facility or Intermediate Care Facility bed on or after September 30, 1989?

• • If NO, stop. Division of assets does not apply.
  • If YES, go to Step 3.

STEP 3:

Determine the first month of the first continuous period of institutionalization or receipt of HCB waiver services which began on or after September 30, 1989. A continuous period of institutionalization is defined as a period in a medical institution and/or nursing facility, which is likely to be at least 30 consecutive days. Even if there has been a break in institutionalization since then, the month of assessment is that month.
