TA Work Requirement: Exemption User Guide

At each Temporary Assistance application, review, or interim change, assess the payee and second parent, if applicable, in the Eligibility Unit (EU) to determine if the individual(s) meets an exemption, exclusion, or are work ready.

 

The following TA individuals may be exempted from the work requirement:

 

Code Exemption Reason Lifetime Limit
01 Custodial Caretaker of a Child 12 Weeks of Age or Younger

These exempted individuals are referred to MWA as volunteers, but will not be sanctioned for non-compliance.

Two Parent Households:

  1. Allow code 01 for one parent in a two parent EU where the children are ‘deprived of parental support’ based on financial need. The second parent will need to be coded “D” mandatory.
  2. Allow code 01 for one parent in a two parent EU where the second parent is disabled and coded 06.

After the 12 weeks have been exhausted, FAMIS will automatically change the individual’s code to “D” mandatory in order to participate with work and training activities

Needed in the Home to Care for a Disabled Individual

A parent or caretaker that is needed in the home to care for a disabled household member who has a physical or a mental disability is exempt from work participation activities.

In order to meet this exemption, there must be no other satisfactory alternative plan or care available.

Verify the need for a parent/caretaker to care for a family member by obtaining a written statement from a physician, psychologist, or psychiatrist

A Permanently Disabled Individual

Must be determined by receipt of Old Age Survivor’s and Disability Insurance (OASDI), Social Security Disability Insurance (SSDI), Supplemental Security Income (SSI) or employer-sponsored disability insurance.

However, this exemption may be used by individuals who have applied for these benefits and are awaiting a final determination. If the application for OASDI, SSDI, SSI or employer-sponsored disability insurance is approved, the exempt code remains 06. If their application is rejected, the individual’s disability must be evaluated by MRT in order to establish continued exemption from work activity participation

        1. BC – Both Orientation and PRP Complete
        2. BI – Both Orientation and PRP Incomplete
        3. OC – Orientation Complete
        4. OI – Orientation Incomplete
        5. PI – PRP Incomplete

          • MRT Approval – The review date displayed on MRTINFO/FMJ
