Changing An Adverse Action Status

FAMIS will complete an adverse action following the 10-day advanced notice of the adverse action unless the worker intervenes to stop the action. If the action is effective in a month prior to the last month of the certification, more than one month is associated with the action on the Select Authorization screen. If a worker intervenes to stop the action, either due to a hearing request, a hearing decision, or a change in circumstances, all the actions associated must be stopped. For example, a notice of adverse action is sent to reduce SNAP benefits for next month. The actions that appear on the Select Authorization screen are AABR (Adverse Action Benefit Reduction) for next month and NOCH (No Change) for the month following, indicating the reduced benefit amount will continue to be paid. The worker receives a hearing request from the EU and places both the AABR and the NOCH on hold.

 

The worker can stop the actions as follows:

Hearing request – When a fair hearing is requested while an adverse action is pending, the EU has the option to continue to receive the current level of benefits pending the hearing results. If the EU chooses to continue receiving benefits at the current level, the pending adverse action is placed on hold (HOL). Agency decision is affirmed in a hearing – When the adverse action was placed on hold and the agency decision is affirmed in a hearing, the adverse action status is changed to authorization pending (AUP) status. If the adverse action period is expired when changed to AUP, the system will automatically take the action overnight in the batch process.

 

Voiding an adverse action – An adverse action may be in a ready to authorize (RTA), authorization pending (AUP), or hold (HOL) status. The RTA or AUP status adverse action may be voided any time prior to expiration of the adverse action notice if there was a change in circumstances and the adverse action is no longer applicable. The HOL status adverse action may be voided if the agency’s decision is overturned in a hearing, regardless of whether the adverse action timeframes have expired.

 

NOTE: Only authorization pending (AUP), ready to authorize (RTA), or hold (HOL) following the authorization of the actions may be voided. Only AUP can be placed on hold. If an action has a status of authorization complete (AUC), the status cannot be changed.

 

Step 1

If you want to fastpath, type “ACTRES” or “FM50” on the command line and press enter. Go to step 2.

 

Step 2

The last Supercase worked on appears in this screen. If this is not the Supercase you want to work with, prompt out for or type the SCN and EU.

 

Step 3

If the message “Eligibility Unit not found” appears and the SCN and EU are correct, there are no authorizations that can be changed. Either the actions are already complete or there are no actions pending. Press F18=SELAUTH to review pending adverse actions for this EU.

 

Step 4

If the message “Successfully displayed” appears, the status of the adverse actions can be changed. Type a “U” in the command line and an “S” in the Com field next to the adverse action(s) to be changed. All associated actions must also be changed.

 

Step 5

Hearing request – If you are placing a hold on an adverse action, prompt for or type “HOL” in the Status field. Enter the date the hearing was requested in the Request Date field. Press enter. The message “Successfully updated” appears.

Agency decision affirmed – If you are authorizing an adverse action after the agency is affirmed in a hearing, prompt for or type “AUP” in the Status field. Press enter. The message “Successfully updated” appears.

Voiding an adverse action – If you are voiding an adverse action, prompt for or type “VOI” in the Status field. Press enter. The message “Successfully updated” appears.

NOTE: When an adverse action is voided, you must review the eligibility information and update any information that is changed. EXAMPLE: An adverse action was sent to close the case due to excessive resources. A hearing was requested and the adverse action was placed on hold. The hearing decision results in the resource being excluded. You must update the resource screen to exclude the resource and record a comment regarding the hearing decision. Complete another eligibility determination (EDRES) and authorize the resulting action.
