SNAP Drug Conviction Exception Guide

Requirement
Anyone convicted in a Federal or State court of a felony related to the illegal possession and use of a controlled substance (drugs) committed after August 22, 1996 is disqualified from the SNAP, unless the individual meets an exception.
When an individual answers Yes to the Drug Felony Driver question, use the Drug Conviction Exception Determination Worksheet (IM-366) to determine if the person meets an exception to the disqualification rules. The IM-366 is available in the Forms Manual (search on 366).
If the person does not meet an exception, and is considered disqualified, complete Sanction/Disqualification (SANDISQ/FMAM), so FAMIS can recommend:

- Single person household – Closing the case or rejecting the application
- Multiple person household(s) – Excluding the disqualified person from the issuance amount, but including his/her income, expenses and resources in the eligibility and allotment determination for eligible household members
