Offender Declarations

 

REQUIREMENT:

At each application and reinvestigation, the Temporary Assistance caretaker must declare the status of all the members of the Eligibility Unit regarding certain criminal offenses. This information is captured on the Declarations (FMMM/DECLARE) screen.

  • FELONY DRUG CONVICTION:

An individual is ineligible to participate in the Temporary Assistance Program forever if convicted in a Federal or State court of a drug-related felony committed after August 22, 1996. These are convictions related only to the illegal possession, use, or distribution of a controlled substance. Drug related offenses committed or convictions occurring on or before August 22, 1996, do not effect eligibility.

  • FLEEING FELONS:

An individual is ineligible to participate in the Temporary Assistance Program during any period while the individual is fleeing or acting with intent to avoid prosecution, custody or confinement after conviction for a crime (or an attempt to commit a crime) that is a felony under the law of the place from which the individual is fleeing. An individual is ineligible to participate during any period in which s/he is violating a condition of probation or parole imposed under a Federal or State law.

  • MISREPRESENTED IDENTITY OR RESIDENCE:

An individual is ineligible to participate in the Temporary Assistance program for a ten year period if convicted in Federal or State court for making a fraudulent statement or representation regarding identity or place of residence in order to receive Temporary Assistance, SSI or Title XIX/ Medicaid simultaneously from 2 or more states. The ten year period begins with the date of conviction.

If the caretaker answers, “Y” to any of the offender questions, the details of the offender’s status are captured on the Declarations Detail (FMMN) screen.
