Legal Separation

When participants separate while still married, it may affect their household composition. If one of the participants leaves the home follow the guides listed below.

TO UPDATE AN INTEGRATED CASE IN THE EVENT OF A LEGAL SEPARATION

If completing this task as part of a returned IM-1U, or if the case is Under Renewal, you must first follow steps to To Create a Manual Renewal and To Complete Manual Renewal.

    1. Legal Separation is treated as a change in address. See Address Change (Home) on an Integrated Case
    2. The tax filing status of the married participants can affect the household composition. See Household Composition flowchart
    3. If the Head of Household is the participant moving out, the remaining household members must reapply to continue receiving benefits.

NOTE: When a legal separation occurs and they remain in the same household, no entry is necessary in MEDES
